INFORMATION ON THE PROCESSING OF PERSONAL DATA

In connection with the processing of personal data, we provide you with the following information pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

SCOPE OF PERSONAL DATA

We try to minimize the scope of the personal data we process, with regard to the high-quality provision of services, so as to fulfil our legal obligations and to protect our legitimate interests. We process the personal data of our customers, as well as the personal data of our potential customers who have given us their consent for this.

We process the following categories of personal data:

  • Basic data, which are your first name and surname, or the Company name, if you are an entrepreneur – a natural person (sole trader)
  • Contact details, which are your e-mail and telephone number.
  • Information about your use of our products and services, about the products you have purchased or are considering purchasing, and the like.
  • Records of e-mail and chat communication, records of telephone calls, or other communication with you in electronic or written form.

PURPOSES OF PROCESSING PERSONAL DATA

We process your personal data mainly for the purpose of preparing business offers, or for communicating with you regarding the request you have submitted in the contact form. This may lead to the conclusion of purchase contracts, the subject of which is the supply of our goods and services. This activity consists mainly of receiving and processing orders, issuing invoices and tax documents, recording payments, sending goods to the chosen address, and so on.

In order to properly fulfil all legal obligations, we also process personal data for the purposes of keeping accounts, records management, or handling complaints and grievances. In some cases, it is also necessary to process personal data for the purposes of court disputes and out-of-court debt recovery.
We also process your personal data for the purposes of informing you about our products and services within the framework of direct marketing.

LEGAL BASES FOR PROCESSING PERSONAL DATA

We process your personal data in accordance with the law, only on the basis of legal grounds in cases where:

The processing of personal data is necessary for the performance of a contract (for example, a purchase contract) and you are a party to the contract, or you have asked us to take measures prior to concluding the contract.
Or the processing of your personal data is necessary within the framework of our legitimate interest, which we pursue and which is primarily the offering and sale of goods and services to our customers
Or you have granted us your consent for one or more purposes. These may include, in particular, activities associated with the offering of goods and services, or processing with the aim of tailoring the offer to your expectations.

PERIOD OF RETENTION OF PERSONAL DATA.

In the case of the consent of the data subject (to receiving news, discounts and price promotions), we will process your data only until you withdraw your consent. 
In the case of legitimate interest, we will process your personal data, unless you object to the processing, for a period that is justified (e.g. with regard to the life cycle of the purchased product or service, so that we can offer and provide you with related products, customer service and services).
In the case of the performance of a contract, we will process your personal data for the period during which the contractual relationship lasts, including the warranty and complaint conditions
In the case of the fulfilment of a legal obligation, we will process your personal data for the period prescribed to us by law. In the case of the Accounting Act, the VAT Act, etc., the period may be 10 years.

YOUR RIGHTS AS A DATA SUBJECT

When processing your personal data, we are prepared to protect your rights.
You have the right of access to your personal data, as well as the right to know for what purpose it is processed, who the recipients of your personal data are, and what the processing period is.
You have the right to rectification if your personal data is incorrect or has changed; contact us and we will correct it.
You have the right to erasure of personal data if it is incorrect or processed unlawfully.
If your personal data is processed on the basis of consent, you have the right to withdraw it at any time, without this affecting the lawfulness of the processing based on the consent given prior to its withdrawal.
You have the right to restriction of processing; if you wish, we will process the data only for the most necessary legal reasons, or not at all.
You have the right to object to automated individual decision-making, if you find out or believe that this processing is unlawful or contrary to your rights.  
You have the right to data portability; if you wish to transfer it to another controller, we will provide it to you in an appropriate format, provided that no other technical or legal obstacles prevent this.

WHERE AND HOW YOU CAN EXERCISE YOUR RIGHTS

You can exercise your rights by calling the telephone number (phone number), in writing at the address 3energy, s.r.o., with its registered office at (address), or by e-mail at obchod@3energy.sk .
We will respond to your request free of charge within a period of up to 30 days. In the case of complexity or a large number of requests, we are entitled to extend this period by a further 60 days. Should this occur, we will inform you of it, as well as of the reasons. 
However, if your request is manifestly unfounded or repetitive, we are entitled to charge a reasonable administrative fee to cover the costs associated with providing this service.
